-         Prepare Option and Mining Claim Purchase Agreement on blocks of patented and unpatented claims in Nevada for gold company client.

-         Prepare Option and Purchase Agreements on blocks of mining claims covering molybdenum prospect in Colorado for mining company client; assist in preparing applications and participate in hearings on local and State permits for exploration and initial mine development.

-         Represent water and sanitation district on groundwater contamination matter resulting from spent-solvent disposal by manufacturing plant; obtained agreement for remedial action and administrative order issued by Colorado Department of Public Health and Environment (CDPHE) to the manufacturing facility.

-         Prepare Articles of Organization and Operating Agreement for Limited Liability Companies (LLCs) conducting consulting and manufacturing business in several western states.

-         Conduct environmental due diligence of industrial minerals companies with operations and facilities in several states for potential acquisition by foreign company client.

-         Obtain settlement of Environmental Protection Agency (EPA) enforcement action against small business for record-keeping and reporting violations where EPA agreed to accept company installing environmental management system (EMS) in lieu of paying penalties. This is the first case in the United States where EPA agreed to an EMS as a Supplemental Environmental Project (SEP) for a small business.

-         Obtained first waiver of enforcement action and penalties for failure to have permit under Colorado environmental audit privilege and immunity law for candy manufacturing facility.

-         Defended large pulp and paper mill in Idaho against EPA enforcement actions for air-emissions violations; obtained settlement with payment of substantially reduced penalties and Supplemental Environmental Projects (SEPs).

-         Represented food processing facility in proceeding before water and sanitation district for pretreatment permit; obtained permit allowing use of onsite equipment and tanks, saving client considerable capital and operating costs.

-         Represented mine operator before Colorado Mined Land Reclamation Board to obtain release of bond and permit obligations imposed by Division of Minerals and Geology (DMG) on closed and reclaimed mine in southern Colorado; obtained settlement by the Board directing DMG to accept available information on mine impacts without requiring a comprehensive groundwater characterization study.

-         Represent potentially responsible parties at Superfund (CERCLA) sites; resolved matters for substantially less than EPA's original demand.

-         Represented major railroad in an action by the Colorado Division of Wildlife seeking fines for a fish kill resulting from a derailment and spill; obtained settlement for less than 10% of the original demand.

-         Advise clients on compliance with Resource Conservation and Recovery Act (RCRA) and other solid and hazardous waste storage, handling and disposal requirements.
